If you’re contemplating or facing divorce, I’ll advocate aggressively for your rights. In Florida, a no-fault divorce state, those seeking a dissolution of marriage need only prove the marriage is “irretrievably broken,” and one party must have lived in the state for at least six months prior to filing the divorce petition. Whether your split is fairly amicable, where essential matters can be agreed upon, or highly contentious, requiring litigation, I will advocate for your best interests. I’ll assist with the equitable distribution of the marital estate, which may include bank accounts, residences, pensions and other assets, and help ensure that separate property is protected. Additionally, I advise couples who choose to legally separate rather than divorce, for financial or other reasons.

Issues involving children can be some of the most difficult to resolve in a divorce. When child custody determinations are involved in a parenting plan, I will work diligently on your behalf toward a resolution that is in the best interests of your children. Florida courts prefer parents to share parental responsibility, or legal custody, so that each is involved in making the important decisions affecting their child’s life, regardless of which parent the children primarily live with. Time-sharing agreements determine how much time the child will spend with each parent and set visitation schedules for the noncustodial parent. My firm assists parents, stepparents and adoptive parents in these custody and visitation matters.

When marriages end, financial hardship may occur. Alimony is intended to improve economic fairness for the spouse who earned less money during the marriage. Considerations that go into alimony include the length of the marriage, the ages of the spouses and whether a parent stayed home to raise children. Child support seeks to equalize the financial burden of raising a child between both parents. Typically, the noncustodial parent is expected to pay child support. I handle alimony and child support negotiations during divorce as well as modifications to final judgments of support orders when a substantial change in circumstances occurs.
